Heard learned counsel for the applicant and learned A.G.A.
appearing for the State.
It is contended by the learned counsel for the applicant that
applicant is brother-in-law (Dewar) of the deceased. There is
general allegation against the applicant.There is no dying
declaration. Cause of death could not be ascertained and
viscera was preserved.
Learned A.G.A. contended that there was dowry demand
and applicant was subjected to cruel treatment and
harassment.
No overtact has been assigned to the applicant. The
applicant is in jail since 12.8.2009.
Considering the facts and circumstances of the case and
submissions made by the learned counsel for the applicant
and without expressing any opinion on the merits of the
case, the applicant is entitled to be released on bail.
Let the applicant Jag Narain involved in Case Crime No.
274 of 2009 , under Sections 304-B, 498-A IPC and section
3/4 of Dowry Prohibition Act Police Station Mohammadabad
District Ghazipur be released on bail on his furnishing a
personal bond with two sureties each in the like amount to
the satisfaction of the court concerned.
