2. In this case, the Appellant had, in his application dated 25 October
2008, requested the CPIO for a number of information regarding (a) the
loans sanctioned under the KCC in a particular branch of the Bank in the
year 2008-09 and (b) the role and responsibilities of the RBO. The CPIO, in
his reply dated 29 November 2008, provided some information but denied
some claiming exemption under Section 8(1) (j) of the Right to Information
(RTI) Act. Against this, he preferred an appeal on 12 December 2008. The
Appellate Authority endorsed the stand of the CPIO in his order dated 30
December 2008. Consequently, the Appellant has come to the CIC in second
appeal against the order of the Appellate Authority.
3. We heard this case through videoconferencing. The Appellant was
present in the Gaya studio of the NIC while the Respondent was present in
the Patna studio. We heard their submissions. In tune with several of our
own decisions in similar cases in the past, we direct the CPIO to provide to
the Appellant within 10 working days from the receipt of this order the
following information:

i) a list of the borrowers under the above scheme and for the period
specified in the application including the name of the borrower, the amount
of loan sanctioned and the purpose for which it was granted;
ii) a copy of the relevant circular of the Bank laying down the procedure for
sanction of loans under the RBO system.
4. The information sought ( item 2 of the application ) regarding the
other borrowers of the Branch fall in a different category as much as that
these do not involve any concessions or relaxations which characterise a
loan scheme like the KCC. Information regarding such loan cases cannot
normally be disclosed as this is held in commercial confidence and and the
disclosure can have adverse effect on the competitive position of those
borrowers.
5. The case is, thus, disposed off.
6. Copies of this order be given free of cost to the parties.
