Mr. Pranab Kumar, learned counsel for

the petitioner submits that a writ petition vide

C.W.J.C. No. 7963 of 2009 has been filed for

assailing the order passed by the authority

pursuant to the order dated 19.01.2001 passed in

C.W.J.C. No. 9789 of 1997 and as such, seeks

permission to withdraw the application.

Accordingly, the application is

dismissed as withdrawn.
