Heard
learned advocate Mr. D.S. Vasavada appearing on behalf of applicant.
This
Court has issued rule to opponent which has been served. Initially,
learned advocate Mr. Amar Bhatt was appearing on behalf of opponent
as copy of this application was served to him and accordingly
endorsement has been made by him.
But,
learned advocate Mr. Vasavada made clear statement before this Court
today that learned advocate Mr. Bhatt has informed him that he is now
not appearing on behalf of opponent.
I
have considered this fact and also considered that rule issued by
this Court has been served to opponent. Considering submissions made
by learned advocate Mr. Vasavada and averments made in this
application supported with affidavit, delay of 58 days is hereby
condoned in the interest of justice as sufficient cause has been
shown by applicant to satisfaction of this Court.
Accordingly,
rule is made absolute to aforesaid extent.
