Facts arising from the Complaint:
Mr. Harish Kumar had filed a RTI application with the PIO, Assistant
Commissioner, Shahadara South Zone, Delhi asking for certain information. Since no
reply was received within the mandated time period of 30 days, the Complainant filed a
Complaint under Section 18 of the RTI Act with the Commission. On this basis, the
Commission issued a notice directing the PIO/AC, MCD (Shahadara South Zone)on
06/11/2009 to provide information to the Complainant and further sought an explanation
for not furnishing the information within the mandated time.

The Commission received a letter dated 08/12/2009 from the PIO/AC, MCD
(Shahadara South Zone) wherein copy of information provided to the Complainant vide
letter dated 25/11/2009 was enclosed. On perusal of the information it has been observed
that the information provided is incomplete. Information given on Query No. 1, 2 and 3
is inappropriate. Further, the Commission is also in receipt of a letter dated 09/12/2009
from the Complainant alleging non-compliance of the Commission’s directions.
Decision:
The Complaint is allowed.
The PIO is directed to provide the complete and correct information in regard to
the queries as mentioned above to the Complainant by 29/01/2010.Proof of dispatch of
information should be sent to the Commission before 03/01/2010. Further, the PIO is
directed to submit a written explanation to show cause as to why penalty should not be
imposed and disciplinary action be recommended against him under Section 20 (1) & (2)
of the RTI Act before 03/01/2010.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
