Heard learned counsel for the petitioner, learned A.G.A. and perused the
record.
Learned counsel for the petitioner contended that the petitioner was married
with deponent Mukesh Shakya though the present Habeas Corpus petition has
been filed. The petitioner and the deponent was major, who solemnised
marriage on her own sweet will on 29th Oct, 2009 which was got registered in
the Arya Samaj Mandir. They were living as husband and wife peacefully.
However, subsequently when petitioner thought and found that her parents
and uncle etc were accepted the marriage. She went there and now she has
been detained and there is continuous pressure to divorce, otherwise
threatening to face serious consequences.
Issue notices to opposite party Nos. 4 and 5 returnable at an early date.
List after three weeks before appropriate/regular Court.
By that time, opposite party Nos. 4 and 5 as well as learned A.G.A. may file
reply, if any.
