Heard learned counsel for the parties.
This is an appeal by the owner and driver of the vehicle which was involved
in the accident.
The Motor Accident Claims Tribunal/ Ist Additional District Judge, Mathura
in M.A.C.P. No. 283 of 2009, Sri Vimlesh Yadav versus Sri Rajesh Kumar
and others by its award dated 26.3.2010 has awarded compensation of a sum
of Rs.24,000/- in favour of the claimant.
Considering the facts and circumstances of this case, it is directed that the
statutory amount of Rs.25,000/- deposited before the Registrar General of this
Court shall be transmitted to the concerned Motor Accident Claims Tribunal
in M.A.C.P. No. 283 of 2009 within 15 days from today. On receipt of the
aforesaid amount from the Registrar of this Court, the claimant shall be
released 50% amount of the awarded amount with interest without furnishing
security and remaining amount after furnishing security.
Issue notice to the opposite parties.
Counter affidavit may be filed within 8 weeks. Rejoinder affidavit may be
filed within 4 weeks thereafter.
List thereafter.
The operation of the impugned award dated 26.3.2010 shall remain stayed till
further orders.
