Applicant- Ravi Parihar seeks bail in Case Crime No. 90 of 2010, under Sections
376, 511, 323 IPC, Police Station Barua Sagar, District Jhansi.
Heard learned counsel for the applicant as well as learned A.G.A. for the State and
perused the material placed on record.
It is argued by the learned counsel for the applicant that similarly placed co-
accused Manish Rai has been granted bail by another bench of this Court on
23.06.2010, vide Criminal Misc. Bail Application No. 15096 of 2010. It is further
contended that applicant is in jail since 02.04.2010, having no criminal history to
his credit deserves to be released on bail at this stage.
The bail is, however, opposed by the learned A.G.A.
The points pertaining to nature of accusation, severity of punishment, reasonable
apprehension of tampering the witnesses, prima facie, satisfaction regarding
proposed evidence and genuineness of the prosecution case were duly considered.
Considering the totality of circumstances of the case, I consider it a fit case to
enlarge the applicant on bail.
Without expressing any opinion on the merits of the case, let the applicant-Ravi
Parihar involved in aforesaid crime be released on bail on his furnishing a personal
bond and two sureties each in the like amount to the satisfaction of the court
concerned with the following conditions that;
1. The applicant will ot indulge in any such activity in future.
2. The applicant will not pressurize/intimidate the prosecution witnesses and
tamper evidence during trial.
3. The applicant will appear before the trial court on the date fixed.
In case of breach of the above conditions, the prosecution would be at liberty to
move application for cancellation of bail. Identity, status and sureties be verified by
the court concerned before the bonds are accepted.
