ORAL ORDER
1. Rule.
Learned APP Mr.L.R.Pujari waives service of notice of rule on
behalf of the respondent No.1-State and learned advocate Ms.Shilpa
R.Shah waives service of notice of rule on behalf of the respondent
No.2-original complainant.
2. Heard
learned advocates for the parties.
3. The
present petitioners are arrested in connection with C.R.No. II –
41 of 2011 registered with Udhna Police Station for the offences
punishable under Sections 323, 504, 506(2), 188 and 114 of Indian
Penal Code. Except offence punishable under Section 188 of IPC, all
offences are compoundable offences. For the offence punishable under
Section 188 of IPC, the imprisonment is for one month and a fine.
4. Taking
into consideration the fact that the dispute is of personal nature,
and after arresting by the police all the accused were released on
bail. The affidavit of complainant is also placed on record in which
it was categorically stated by the complainant that without any
pressure or threat he has entered into settlement with the accused
persons and now he has no grievance.
5. In
view of the above, the petition is allowed. The complaint C.R.No.
II – 41 of 2011 registered with Udhna Police Station is hereby
quashed and set aside. Rule is made absolute.
