ORDER
Invoking
provisions of Section 482 of the Criminal Procedure Code, the
petitioner husband has called into question the order in his favour
made by learned Additional Sessions Judge, Vadodara, in his Criminal
Revision Application No.46 of 2008. By the impugned order, revision
of the petitioner was partly allowed and the amount of maintenance of
Rs.15,000/- per month awarded to the respondent, estranged wife, was
reduced to Rs.8,000/- per month. The main contention of the
petitioner althroughout was that the petitioner did not have
sufficient taxable income to maintain himself, his children and also
pay higher amount of maintenance to the wife. Considering the
figures of his income and sources of income, which included
agricultural income, Sessions Court was inclined to reduce the amount
of maintenance. No reason was made out to take a different view of
the matter and there being no failure of justice, in the facts of the
present case, the petition is dismissed in limine.
