ORDER

1.0 Heard
learned advocate Mr. NA Shaikh for the applicant – original
petitioner. No ground is made out for restoration of the matter.

2.0 Learned
advocate Mr. Shaikh submitted that on 6th September 2010
when the matter was called out he was busy before another Court and
incidentally, that matter was also adjourned to 8th
September 2010 and therefore, on 8th September 2010, after
remaining present before this Court till 3:30 p.m. he went to attend
that other matter.

2.1 Even
if it is true, he could have asked any friend to mention that, ‘the
learned advocate is busy in another Court’. The aforesaid submission
is also found to be far from the truth because the matter was called
out in the first half in first round, the learned advocate Mr. Shaikh
was not present. The matter was kept back. It was then called out
in the second half. In second half, on second call also he was not
present.

3.0 Hence,
no ground is made out for restoration. Hence, this application is
dismissed.
