The petitioner has sought the quashing of the order dated
23.7.2010 passed by Head of Department, S.S.V.P.G. College,
Hapur, Meerut by which the decision taken by the University to
cancel the admission of the petitioner in B.Ed. for the Academic
Session 2008-09 has been communicated. It is stated in the order
that after counselling the petitioner was allotted Saraswati College
of Professional Studies, Ghaziabad but the petitioner took
admission in Saraswati Vidyalaya College, Hapur District
Ghaziabad.
Learned counsel for the petitioner has submitted that when the
petitioner reported for admission at the Saraswati College of
Professional Studies, Ghaziabad she was informed that her name
was not included in the list of candidates to be admitted and she
should report at Saraswati Vidyalaya College, Hapur where the
petitioner reported and was granted admission. He further submits
that since the University has wrongly cancelled her admission she
may be permitted to appear at the examination which is scheduled
to commence from 10.8.2010.
Sri Sanjay Kumar Singh appears for respondent nos.1 & 3 and Sri
Anurag Khanna for respondent no.4. Issue notice to respondent
no.2 by registered post. Steps may be taken within a week.
Respondents may file counter affidavit within two weeks.
Rejoinder affidavit, if any, may be filed within a week thereafter.
List this petition for admission/hearing in the week commencing
13th September, 2010.
In view of the submissions advanced by learned counsel for the
petitioner, the petitioner is provisionally permitted to appear at the
examination which is scheduled to commence from 10.8.2010 but
her result shall not be declared until further orders.
