1. Counsel for the petitioner submitted that the petitioner is
legally wedded wife, whereas counsel for respondent no. 8 says that
she is legally wedded wife, of the deceased employee. Counsel for the
respondent no. 1 says that compassionate appointment has been
given to the petitioner and counsel for respondent no. 7 says that
petitioner’s name is reflected as nominee for getting Coal Mines
Provident Fund amount.
2. It is stated by the counsel for respondent no. 8 that
respondent no. 8 is waiving and relinquishing her right to get an
amount under the Coal Mines Provident Fund Scheme in favour of
the present petitioner and an affidavit to that effect shall be filed
during course of the day. One affidavit is filed today, but, the same is
not that much clearer and therefore, one more affidavit shall be filed
during course of the day. All the necessary papers for getting Coal
Mines Provident Fund amount shall also be signed/countersigned by
the petitioner as well as by respondent no. 8 and respondent no. 8
shall not claim for any amount towards Coal Mines Provident Fund
Amount from respondent nos. 1 to 7.
3. In view of these submissions and on condition that such
affidavit shall be filed today, I, hereby, direct the petitioner as well as
respondent no. 8 to sign necessary papers before respondent nos. 1 to
6 so that an amount under the Coal Mines Provident Fund Scheme
can be paid to the petitioner. This exercise of signing the necessary
documents shall be completed within a period of one week from the
date of receipt of a copy of this order, if necessary and the legally
payable amount under the Coal Mines Provident Fund Scheme, shall

be paid to the petitioner, within a period of twelve weeks from the
date of receipt of a copy of this order.
4. In view of the aforesaid directions, this writ petition
stands disposed of.
