JUDGMENT

This writ appeal is at the instance of the management of an
unaided college.
2. The appellant impugns the judgment of the learned
Single Judge in W.P.(C) No.33006 of 2008 by which the appellant has
been directed to execute the necessary agreement with the Government
in the prescribed format.
3. Anyhow, we need not refer to the various contentions
raised by the parties in the writ petition at this stage, in view of the
intervening development.
4. When this writ appeal was taken up for consideration on
October 28, 2009, the learned Government Pleader on getting
instructions from the Director of Collegiate Education had informed us
that the Director had already received the application from the
appellant for grant of No Objection Certificate and that the application

was being processed. In response to the above, the learned counsel
for the appellant submitted that the management was prepared to
enter into an agreement with the Government at the earliest as insisted
by the University.
5. Today when the case has come up for further
consideration, learned Government Pleader submits that the appellant
had already been heard by the Secretary to Government in this regard.
He further submits that all necessary steps would be completed and
agreement executed without any further delay, at any rate, within an
outer limit of two weeks.
6. The above submission is recorded and the writ appeal
is closed with a direction to respondent No.1 to ensure that the
agreement between the Government and the appellant is executed
within two weeks from today.
