Heard learned counsel for the applicants and the learned A.G.A. for the State.
This application has been filed on behalf of the applicants Ranjeet Verma and
Pramod Kumar who are accused in Case Crime No. 406 of 2010, under
Sections 419, 420, 272, 273 I.P.C., and 7/16 Food Adulteration Act,
registered with P.S. Khorabar District Gorakhpur for being enlarged on bail
during the pendency of the trial.
It is contended that the applicants are neither owners nor proprietors of the
shop from which the adulterated skimmed milk was seized. It has been also
been contended that the owner of the shop is Nand Kumar Gupta and the
applicants were merely working as labourers in the shop of Nand Kumar
Gupta,, at the relevant point of time and they have no concern with the
skimmed milk from the shop of Nand Kumar Gupta.
It has next been contended that the applicants who have no criminal history to
his credit which are in jail since 25.3.2010
The bail prayer has however been opposed by the learned A.G.A.
Considering the nature of submissions made on behalf of the applicants and
the fact that the applicants have no criminal antecedents, this court is of the
view that the applicant is entitled to be enlarged on bail.
Let the applicants Ranjeet Verma and Pramod Kumar involved in Case Crime
No. 406 of 2010, under Sections 419, 420, 272, 273 I.P.C., and 7/16 Food
Adulteration Act, registered with P.S. Khorabar District Gorakhpur be
released on bail on his executing a personal bond and furnishing two sureties
each in the like amount to the satisfaction of the court concerned subject to
the following conditions:-
I.The applicants shall record his attendance before the concerned C.J.M. on
the 7th day of every month.
II.The applicants shall not tamper with the prosecution evidence.
III.The applicants shall co-operate in the early conclusion of the trial and will
not seek any unnecessary adjournments.
In case of breach of any of the above conditions, the trial court will be at
liberty to cancel the bail.
