2 24-10-2011 Heard learned counsel for the petitioners, learned

counsel for the informant and learned Additional Public Prosecutor

for the State.

Petitioners apprehend their arrest in connection with

Manihari P.S. Case No.- 21 of 2011 for the offences punishable

under Sections 406, 409, 420 and 120(B) of the Indian Penal Code

pending in the court of the learned Chief Judicial Magistrate,

Katihar.

The allegation against both the petitioners are that

they forged and fabricated documents and have misappropriated

about Rs. 3,97,000/- which was sought to be distributed under the

Diesel Subsidy Scheme of the Government due to draught.

Petitioner no. 1 is supposed to be the Mukhia and Petitioner no. 2

is Panchayat Sachiv.

Learned counsel for the informant has obtained

certain information under Right to Information Act, which shows
that all kinds of name have been inserted in the list of beneficiaries

which include the name of the father of Petitioner no. 1 and none

have paid a penny. Obviously there has been creation of evidence

to misappropriate Government funds.

In view of the above and seriousness of the allegation

let, the petitioners surrender or move for regular bail before court

below. On this count the Court below shall consider the regular

bail application on its own merit.

In view of the above, the prayer for anticipatory bail

of the petitioners is rejected.
