There appears to be some dispute regarding the measurement
given by him with respect to culvert and the culvert which is
actually on the spot. According to the case of the railways culvert
was 2.4 meters width whereas Mr. S.K.Kalia, learned Senior
Advocate says that it is 7 meters in width. The problem requires
solution so that railways are not deprived of their right to get the
goods shed repaired which is their own property. But at the same
time, the industries, which are situated there may not face the road
blockade.
List on 6.4.2010 on which the District Magistrate concerned shall
also appear in person before this Court for assistance along with
Sri Jitendra Kumar in deciding the dispute.
Interim order shall continue till the next date of listing.
