Heard counsel for the petitioner. No notice is issued to respondents in view of
the order proposed to be passed today, however, liberty is reserved for
respondents to apply for variation or modification of this order if they feel so
aggrieved.
Only prayer pressed by the petitioner in the writ petition is that a direction be
issued to the Executing Court to dispose of Execution Case No.13 of 2005
(Jitendra Vs. Smt. Krishna Rani and others).
The execution case being pending for the last more than five years, we
dispose of the writ petition with the observation that the Executing Court shall
proceed to expeditiously dispose of the aforesaid execution case preferably
within a period of six months from the date of production of a certified copy
of this order.
