ORDER

The
appellant has preferred the present appeal under Section 374 of the
Code of Criminal Procedure, 1973 against the Judgment and Order of
conviction dated 19th December 2008 passed by the learned
Additional Sessions Judge and Special Judge, Kheda at Nadiad, in
Special Case (GEB) No.34 of 2007, by which the learned trial Judge
was pleased to convict the present appellant under Section 135(1)(A)
of the Electricity Act, 2003 and ordered to undergo rigorous
imprisonment for a period of two years and also imposed fine of
Rs.3,27,000/-, and in default of payment of fine, ordered to undergo
simple imprisonment for a further period of six months.

Heard
Mr.C.B. Dastoor, learned counsel for the appellant and Mr.R.C.
Kodekar, learned Additional Public Prosecutor for the
respondent-State.

Mr.Dastoor
has contended that the appellant has expired on 15th June
2009 and places on record Death Certificate of the
appellant-Thakorbhai Ishwarbhai Patel.

I
have perused the papers as well as submission advanced by
Mr.Dastoor. On perusal of the papers, it appears that the appellant
has expired on 15th June 2009. Hence, in view of death of
the the appellant, present appeal stands disposed of as abated.
