1. It is informed that the Principal, Government Girls’ High School, Bariyatu, Ranchi and Treasury Officer, Ranchi were present on 18th March, 2005 but no appearance could be recorded as the case was not taken up on the said date.
2. A show cause has been filed by O.P. No. 2. Counsel for the State submits that the death-cum-etiral benefits to which the petitioner was entitled have now been paid.

Counsel for the petitioner submits that the benefit of 12 months special leave, on half average pay, to which the petitioner was entitled as his wife (deceased Government employee) was suffering from cancer and later on died, has not been paid to which he is entitled as per Note-3 below annexures enclosed below Rule 243 of the Bihar Service Code, 1950/Jharkhand Service Code, 2001. It was inserted by Memo No. 731-2F, dated 26th September, 1969. It is further stated that 5% interest for delayed payment to which the petitioner is entitled as per Court’s order has not been paid. The other grievance of the petitioner is that 60% of deposited group insurance amount in addition to the total group insurance of Rs. 96.000/- to which the petitioner was entitled as per Government Resolution No. 4185-B(2), dated 13th July, 1985, has also not been paid to the petitioner. It is also alleged that the family pension has not been fixed properly as per Finance Department Resolution No. PC-01/99-11558 B. Pen., dated 22nd December, 1999 and less amount has been fixed for payment.

In the facts and circumstances, instead of proceeding in the matter for the present, the case is remitted to the Principal, Government High School, Bariyatu, Ranchi with a direction to take up the matter with the competent authority and, if necessary, with the Accountant General, Bihar & Jharkhand and determine the claim as made by the petitioner including the interest to which he is entitled as per the Courts order within one month from the date of communication of this order and pay the admitted dues to the petitioner, within two months from the date of receipt of this order.
5. The petitioner is given liberty to file a fresh representation in respect to the aforesaid grievance enclosing the copy of the relevant circulars and rules.
6. This application stands disposed of, with the aforesaid observations/directions.
