Rule.

We
have heard Mr.N.J.Shah, learned AGP and Mr. S.J.Gaikwad appearing for
respondents.

This
is an application for condonation of delay caused in filing the
Letters Patent Appeal.

Considering
the contents of the application and after having heard the learned
counsel for the parties, we are of the view that it cannot be said
that the delay caused in filing the appeal has remained totally
unexplained. Therefore, we are of the view that this application
deserves to be allowed and it is accordingly allowed. Delay is
condoned. Rule is made absolute.
