Background

1. The  decision in the captioned case given by the Commission on 20.11.09 is as follows:

(i) The Respondent submitted  that the RTI application was received on 13.8.09 and reply was 

provided   on   20.8.09   even   though   the   Complainant     had   not   paid   the   RTI   Fees.     The 

Respondent   further stated   that the Complainant   had applied for a   fresh passport on 

2.7.08 and on scrutiny it was found that he had not furnished documentary evidence of his 

date of birth in his passport application and he did not furnish the same till date even though 

he has been requested to do so.

(ii) After   hearing   the   submission   of   the   Respondents,   the     Commission   advises   the 

Complainant to submit a fresh application along with the required documents  indicating his 

date  of  birth  and  directs the CPIO to provide the passport within 15 days of receipt of 

documents from the Complainant.

2. The Bench of Mrs. Annapurna Dixit, Hon’ble Information Commissioner, heard the matter again for 1 

June 2010.

3. Shri Shrawan Kumar Verma, Passport Officer & CPIO represented the Public Authority.

4. The Appellant, Shri Nawab Baig, was present during the hearing.
Decision

5. The   Respondent   submitted   that   the   passport   could   not   be   issued   since   the   Appellant   had   not 

furnished any document certifying his date of birth. The Appellant, however, stated that he had sent 

his   school   certificate   giving   is   date   of   birth   along   with   his   application.     It   was   clear   from   the 

Respondent’s submission that the certificate had got lost during transit.  The  Appellant provided a 

copy of the School certificate during the hearing to the Respondent and the assured the Appellant as 

well as the Commission that the passport would be issued to the Appellant within two days. The 

Appellant was satisfied with this assurance .

6. Since the Grievance of the Appellant has been redressed; the case is accordingly disposed of.
