Both the Courts ( learned Trial Court and also the learned
Ist Appellate Court ) recorded a finding of affirmative character which
is relatable to the material obtained on the file.
Even otherwise, the revisional Court would, obviously, not be
inclined/authorised to interfere (with the judicial discretion exercised by the
learned Trial Court and the learned Ist Appellate Court) unless if it is found
that the learned Trial Court and also the learned Ist Appellate Court had
exercised discretion in an injudicious or perverse manner. It is not so in the
present case. The judicial discretion by the learned Trial Court and also
learned Ist Appellate Court deserves affirmation and it is so ordered
accordingly. However, the petition is disposed of with a direction that
the learned Trial Court shall dispose of trial itself within six months
from the next date of hearing.
The acknowledgment (of a copy of this order) issued by the
concerned Judicial Officer shall be forwarded to the Registry of this Court.
Learned Sessions Judge shall himself maintain a tab to ensure that the
case is disposed of by afore-mentioned date.
