Background
1. The Applicant filed his RTI request on 02.04.09 with the CPIO, Southern
Railway, Chennai requesting action taken report on his representation dated
14.04.07 and copy of action report on his representation dated 05.09.09
given to Welfare Inspector in connection with grievance Adalat. The PIO
replied on 02.05.09 informing the applicant that the representation has been
forwarded to Sr. DPO on 16.05.07 and enclosing copy of the reply received
from DRM on 04.03.08. He also enclosed a copy of the action taken on his
letter provided on 05.09.08. DRM vide letter 04.03.08 informed the applicant
that in connection with the court case file in the CAT cum labour court the SR
has been obtained from the division and that CGIT/Bangalore has directed to
pay the officiating allowance for the period from 01.04.94 to 30.11.2000 for
Rs.56,669/-. Accordingly the payment has been arranged through cheques
and necessary entries have been made in SR. He also informed the appellant
that since the case is closed, the service register of the said employee is
being sent for further maintenance. Being aggrieved with the reply, the
applicant filed his first appeal on 03.06.09 once again seeking information
against 2 points as sought in the RTI application. The appellate authority in
his order dated 09.07.09 informed the appellant that his appeal is unsigned
however the appellate had gone through the whole and found that required
information has been provided. He also stated that the appellant is making
repeated application raising the personal grievance pertaining to 15 years
back concerning his pay fixation while working under another administrative
authority. Still being aggrieved with the reply, the applicant filed his Second
Appeal before the Commission seeking information once again.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing on 31st March, 2010 through video conferencing.
3. Mr. Denis, Appellate Authority and Mr. K. Rajendran were present at NIC
studio, Chennai.
4. The Appellant was present at NIC studio, Chennai.
Decision
5. On perusal of submissions of both sides the Commission directs the
concerned PIO to allow inspection of relevant files by the Appellant pertaining
to his arrears, gratuity etc. and to provide him with copies of documents he
requires, free of cost. The information may be provided by 5 May, 2010.
6. The appeal is accordingly disposed of.
