2/   09-07-2010            Heard the parties.

                           Petitioner   apprehends    his   arrest   in   a   case

instituted for offences under section 379, 354, 448 and

some allied offences under the Indian Penal Code.

It is submitted that the petitioner as also other

accused persons at one side and the informant and his

supporters on other side are on litigating term from before

and a civil suit is also pending between them. The

petitioner along with his all other family members are

alleged to have entered inside the house of the informant

and allegedly assaulted by fists, slaps etc. Petitioner is

further alleged to have taken out Rs. 7,000/- from the

pocket of the informant.

Be that as it may , in view of the fact that Title

Suit No. 56 of 2007 is pending between the parties, and

both sides are neighbours, it is directed that in the event of

his arrest or surrender in the court below within a period

of four weeks from today, let the above named petitioner be

enlarged on bail on furnishing bail bond of Rs. 10,000/-

with two sureties of the like amount each to the

satisfaction of C.J.M., Bhagalpur in connection with

Kahalgaon ( Ghogha ) P.S. Case No. 93 of 2010 ( G. R. No.

692 of 2010) , subject to conditions as laid down under

section 438(2) of the Cr. P.C..
