Facts
:
The Commission has received a complaint from Shri Ranjan Kumar Jha of
Madhubani, Bihar that his request under RTI Act, 2005 submitted to Central
Public Information Officer, Ministry of Home Affairs, New Delhi seeking
information on various issues including the Central Police Officers *Asst
Commandant’s) Exam 2006 has not been responded to, even though the same
was duly submitted along with the requisite fee dated 07-09-2007.
Admitting the Complaint of Shri Jha under Section 18 (1) (b) of RTI Act,
2005 as deemed refusal the Commission issued a notice to the CPIO, UPSC for
furnishing comments on his complaint. In response, the CPIO & Deputy
Secretary Shri Rameshwar Dayal submitted his comments dated 16 February,
2009. The CPIO informed the Commission inter alia that as per the available
record the request dated 07-09-2007 of Shri Ranjan Kumar Jha had not been
received in the Commission but he assured that the information sought by Shri
Jha was being sent to him shortly in respect of his application enclosed with the
Notice issued to them by the Commission. Thereafter copy of information sent to
Shri Jha was endorsed to this Commission also.
Decision
From the available record it appears that the request dated 07-09-2007 of
Shri Jha has now been responded by the CPIO Deputy Secretary Shri
Rameshwar Dayal by a letter of 6.3.’09. If not to his satisfaction ,Shri Ranjan
Kumar Jha is free to file 1st appeal before the First Appellate Authority of the

Union Public Service Commission, the details of which have been provided to
him in the letter of 6.3.’09 under Sub-sec. (1) of Sec 19 of the RTI Act 2005.
This complaint now stands disposed of. Notice of this decision be given
free of cost to the parties.

Authenticated true copy, additional copies of order shall be supplied against
application and payment of the charge prescribed under the Act to the CPIO of
this Commission.
