JUDGMENT

1. The petitioner filed CWP No. 8281 of 2005 for a direction to the respondents to appoint him on the post of JBT Teacher. The said writ petition was disposed of on 7.10.2005 with a direction to consider the petitioner’s claim in the light of various judgements passed by this Court from time to time, within a period of 3 months.
2. Alleging non-compliance of above-stated order, this contempt petition has been filed.
3. In response to the show cause notice, an affidavit has been filed by Shri Anand Sharma, IAS, Director, Elementary Education Haryana, Chandigarh and along with the said affidavit, he has also appended a copy of the speaking order dated 7.6.2006 (Annexure R-1) whereby the petitioner’s claim has been considered and rejected.

Learned Counsel for the petitioner vehemently contends that the aforementioned order does not depict the correct and true factual position as vacancies in general category are available against which the petitioner can be appointed as per his placement in the waiting list. The aforementioned contention, however, is being disputed by learned State counsel.
5. After hearing learned Counsel for the parties, the Director Elementary Education, Haryana, is directed to supply to the petitioner brief information in relation to the following:
(i) The number of total selected candidates in the general category;
(ii) The number of total candidates of general category placed in the waiting list;
(iii) Serial number of the petitioner in the waiting list;
(iv) How many candidates of general category from the ‘main selection list’ as well as from the ‘waiting list’ have since been appointed;
(v) After the aforesaid appointments, what is the present status of the petitioner as per his placement in the merit list.
6. The aforementioned information may be supplied to the petitioner within one month from today. With these directions, this petition is disposed of with a further liberty to the petitioner to impugn the order dated 7.6.2006 (Annexure R-1), if so advised.
