Facts
arising from the Complaint:
Mr. Jitender Rajput had filed a RTI application with the PIO, MCD, Engg.Deptt, Room No.2, Near Gate
No.04, Dr Ambedkar Stadium, New Delhi on 26/05/2010 asking for certain information. However on not having
received the information within the mandated time, the Complainant filed a complaint under Section 18 of the RTI
Act with the Commission. On this basis, the Commission issued a notice to the PIO, O/o Asstt. Commissioner,
CED, Town Hall Delhi-110006, on 08/10/2010 with a direction to provide the information to the complainant by
02/11/2010 and a copy of the information sent to the Complainant and further sought an explanation for not
furnishing the information to the commission by 12/11/2010.
The Commission received a copy of the letter dated 02/11/2010 sent to the Complainant by the PIO, Central
Establishment Department wherein it has been stated that the Complainant had filed an Appeal with the Assistant
Commissioner, Central Establishment Department. However, no such Appeal was received in the office of the
aforesaid department. It was further stated that a copy of the Complaint dated 16/09/2010 and a copy of the RTI
application was forwarded to the PIO, Room No.2, Dr. Ambedkar Stadium for providing the requisite information.
On perusal of the above papers, it was observed that no information has been received from the PIO, Room
No.2, Dr. Ambedkar Stadium.
Decision:
The Complaint is allowed.
In view of the aforesaid, the PIO, Engg Dept., MCD is hereby directed to provide the complete and correct
information on all the queries in the RTI application dated 26/05/2010 to the Complainant before 20/01/2011, with
a copy to the Commission.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
