This case instituted against unknown relating to

murder of brother of the informant. The petitioner’s name

emerged subsequently in connection with Muffasil P.S.

Case No. 267 of 2008 for offences under Sections 302/34

of the I.P.C.

Petitioner’s name was disclosed during

investigation by one Banshidhar Choudhary @ Bindurjee

who was apprehended in his confessional statement. It is

stated that Banshidhar Choudhary @ Bindurjee has not

only been granted regular bail but also it appears that he

has been already acquitted under section 232 of the

Criminal Procedure Code finding no evidence there

appears absolutely no other material against the petitioner.

Considering the facts and circumstances of the

case, in the event of his arrest/surrender before the court

below within four weeks of receipt of the copy of this order,

petitioner, namely, Mukesh Singh, is directed to be

released on bail on furnishing bail bond of Rs. 10,000/-

(ten thousand only) with two sureties of the like amount

each to the satisfaction of Chief Judicial Magistrate,

Begusarai, in connection with Begusarai Mufassil P.S.

Case No. 267/2008. Subject to condition laid down under

Section 438(2) of the Criminal Procedure Code with

additional condition to attend the court during trial on

each and every date at least for one year or till

conclusion of the case whichever is earlier, in case of

failure on two consecutive dates, the liberty shall be

deemed to be cancelled.
