The learned counsel for the petitioner
contended that offence under Section 379 IPC is
triable by Magistrate, therefore, application
for bail of the petitioner be considered.
The learned PP contended that
petitioner is habitual offender as seven other
cases are pending against him, which is clear
from para 6 of the order dated 10th April, 2009
passed by the Sessions Judge, Bhilwara.
I have considered the submissions of
learned counsel for both the parties and in
view of all the facts and circumstances of the
case, I am not inclined to allow this bail
application and the same is, accordingly,
dismissed.
