Heard learned counsel for the petitioner and Shri S.M.Bajpai learned counsel
for the respondent Bank as well as learned Chief Standing counsel.
Petitioner has approached this court under Article 226 of the Constitution of
India against the recovery proceeding initiated against him by the respondents
on account of non-payment of dues.
Respondents counsel submits that he has no objection in case petitioner pays
the entire dues on early date may be in easy instalments.
Keeping in view the facts and circumstances of the case, respondent Bank is
directed to provide statement of account to the petitioner within a period of
fifteen days from the date of receipt of a certified copy of this order.
Thereafter, petitioner may be permitted to pay the entire dues in three equal
quarterly instalments. The first instalment shall fall due in the month of
August, 2010. In the event of default of payment of dues, it shall be open to
the respondents to proceed in accordance with law to recover the dues.
Subject to above, writ petition is disposed of finally.
