4/- 11-07-2011 Heard learned counsel for the petitioner and learned
additional Public Prosecutor for the State.
Petitioner is named accused in this complaint case with
specific allegation as mentioned in paragraph no. 5 of the
complaint petition that in order to return the money taken as
advance he has issued two cheques worth Rs. 60,000/- each in
favor of the complainant but both have been dishonored. Though,
there is nothing mentioned in the bail application as regard to
same, but during course of argument, it is submitted that the
petitioner Sanjay Kumar Keshri @ Mantu has neither issued any
such cheque nor there is anything on record before the court below
showing such issuance of cheques. Subject to verification and
only on finding that no such cheques have been issued (as
mentioned in paragraph no. 5 of the complainant petition), let the
petitioner, namely, Sanjay Kumar Keshri @ Mantu in the event of
arrest /surrender before the court below within four weeks of
receipt of the copy of this order, is directed to be released on bail
on furnishing bail bond of Rs. 10,000/- (ten thousand only) with
two sureties of the like amount each to the satisfaction of Sub-
Divisional Judicial Magistrate, Rohtas at Sasaram , in connection
with Complaint Case No. 1147 of 2010, subject to condition laid
down under Section 438 (2) of the Criminal Procedure Code with
additional condition to remain physically present before the court
below on each and every date at least for two years or till disposal
of the case, whichever is earlier, in case of failure on two
consecutive dates without any reasonable explanation, the liberty
granted shall be deemed to be cancelled.
