2. 15.10.2011 Heard learned counsel for the petitioner as well

as learned Additional Public Prosecutor for the state.

Petitioner apprehends his arrest in connection

with Naubatpur P.S. Case No. 142 of 2011 under Sections

7 of the Essential Commodities Act and Section 120B of

the Indian Penal Code.

Petitioner is one of the named accused in this

case being owner of tractor trolley upon which 121 bags

containing 50 kg of wheat each was recovered on

suspicion that it is being carried for sale in black market.

The owner of the aforesaid wheat is co-accused Kishori

Sao and the name of the petitioner appears only on

suspicion due to the bags containing monogram of F.C.I.

and there is nothing to involve the petitioner in the case.

Considering the facts and circumstances of the

case in the event of his arrest/surrender before the court

below within a period of four weeks from today, let the

above named petitioner be released on anticipatory bail on

furnishing bail bond of Rs. 10, 000/- (ten thousand) with

two sureties of the like amount each to the satisfaction of

Chief Judicial Magistrate, Patna in connection with

Naubatpur P.S Case No. 142 of 2011, subject to the

conditions as laid down under Section 438(2) of the Code

of Criminal Procedure with additional condition to remain

physically present before the court below on each and

every date at least for one year or till disposal of the case,

whichever is earlier, in case of failure on two consecutive

dates, without giving any reasonable explanation, the

liberty granted shall be deemed to be cancelled.
