Inspite of the repeated calls at different intervals of the day,
none has entered appearance on behalf of the petitioner.
In the course of the petition, there is an averment that
quashment of the proceedings before the learned Trial Court is applied for
as the parties had compounded the office. Reliance, in support of the
averment, is placed upon the testimony on oath of first informant which
came to be recorded before the Trial Court. No compounding deed has
otherwise been placed on record. A copy of the statement aforesaid in
entirety has also not been placed on record. The quoted portion of that
statement does not indicate the statement in entirety inasmuch as it
(quoted portion) does not indicate that the witness had been subjected to
any cross-examination or, in any case, opportunity of cross-examination
had been afforded to the opposite party.
For the reasons noticed above, the petition is dismissed on
account of non-prosecution and for want of merit even otherwise.
