The
present application is for condonation of delay of 14 days in
preferring the appeal against the judgement and order of the
Tribunal dated 18.1.1998 in MACP No.270 of 1999.

Heard
Mr.Sood, learned Counsel for the applicant – appellant and
Mr.Umang Vyas, learned Counsel for the original claimants –
opponents No.1 and 2. Other opponents are served, but none appears.

Considering
the facts and circumstances and in view the grounds mentioned in the
application for condonation of delay, sufficient cause is made out.
Hence, delay deserves to be condoned and, therefore, condoned.

The
application is allowed to the aforesaid extent. Rule made absolute
accordingly.

The
appeal be listed for hearing on 22.2.2011.
