Heard learned counsel for the petitioner as well as
learned Additional Public Prosecutor for the State assisted by
learned counsel for the informant.
It is stated that petitioner opened fire causing fire
arm injury to one Sabloo Mandal. Annexure-3 is Photostat copy
of injury report of injured Sabloo Mandal. It appears that
though the said Sabloo Mandal has sustained fire arm injury but
the said injury is said to be simple in nature and he has received
injury on his thigh. There is case and counter case between the
parties.
Learned counsel for the petitioner points out that in
course of investigation, the above said Sabloo Mandal was not
examined by the Investigating Officer.
Learned counsel for the informant points out that
earlier the petitioner was released on provisional bail by this
Court but when he came out from the jail, he threatened the
witnesses for which a sanha bearing Sanha No. 1592 (J) of
2011 has been lodged in the court of Chief Judicial Magistrate,
Munger.
Considering the aforesaid facts and circumstances
as well as submissions of the parties, let the petitioner be
released on bail on furnishing bail bonds of Rs. 10,000/- (Ten

Thousand) with two sureties of the like amount each to the
satisfaction of Chief Judicial Magistrate, Munger in connection
with Mufassil P.S. Case No. 63 of 2011.
