The petitioner is an accused in the case registered for the offence under
section 414 of the Indian Penal Code and section 25(1-b)a, 26 and 35 of the
Arms Act.

Learned counsel for the petitioner submitted that the petitioner has been
falsely implicated in the case; it is a matter of fact that nothing incriminating has
been recovered from his possession; the allegation of recovery of fire arm and
one Nokia Mobile is wholly false and concocted; petitioner was also implicated
in four criminal cases earlier, but after trial, he has been acquitted of the
charges in two cases and in one case, he is on bail; co-accused-Vijay Kumar
with similar allegation has been granted bail by this Court in B.A. no.1713 of
2011; he is in custody since November,2010; petitioner is a local permanent
resident; there is no chance of his absconding.

Learned APP opposed the prayer for bail of the petitioner, but has not
disputed the contention made by the learned counsel for the petitioner.

Regard being had to the facts and circumstances of the case, the above
named petitioner is directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
satisfaction of learned Judicial Magistrate, 1st Class, Ranchi in connection with
Dhurwa P.S. case no.202 of 2010, corresponding to G.R. Case no.4786 of
2010.
