Facts
:-
The complainant Smt. Kiran Agrawal by her RTI application dated 21/11/2008 sought
information from CPIO, BSNL Limited, Telephone Bhawan, Patna regarding action taken on
her letters of complaint and action taken on the same. Failing to receive a response from CPIO,
she preferred first appeal dated 20/03/2009 to FAA which was not adjudicated upon.
2. Accordingly, complainant has preferred second appeal before the Commission which
was treated as complaint u/s 18 of the RTI Act.
3. Accordingly, Show Cause notice was issued to the CPIO dated 19/05/2010 to Show
Cause why a penalty should not be imposed upon him for failing to act within the time frame
stipulated under the Act. An opportunity to be heard in person before imposing penalty was
provided to the CPIO, O/o PGMTD, Patna.
4. Accordingly, the matter was heard today. Complainant was not present. Respondent
was present as above. CPIO explained that the said RTI application was received by CPIO, O/o
Chief General Manager(Telecom), Bihar Circle Office, Patna, and forward to him, which he
received on 01/05/2009. Following this, he provided information to the CPIO, O/o PGMTD,
Patna, vide his order dated 20/06/2009.
5. Meanwhile, the complainant had preferred first appeal dated 20/03/2009 to which she
did not receive any response.
6. The matter was heard today.
DECISION
7. The CPIO, O/o PGMTD explained that the matter had since been resolved.
8. The complainant also called up the Office of the Commission and informed that she
was fully satisfied and she has withdrawn her complaint.
9. Accordingly, the matter is closed at the Commission’s end.
