offence is disclosed. Victim has sustained injuries.

In such a view, the prosecution of Case No. 2978/09, u/s 323, 452, 504, 506
IPC, P.S. Line Bazar, district Jaunpur, pending in the court of ACJM, First,
Jaunpur cannot be quashed.

This application is dismissed.

Interim order dated 8.10.2009 stands vacated.

Bail prayer of the applicants is directed to be considered on the same day by
both the courts below.
