Heard learned counsel for the petitioners as well as learned

P.P. for the State assisted by the learned counsel for the informant.

Petitioners seek their bail in connection with Dawath P.S.

Case no.45/2010 registered under section 307 and other minor

sections of the IPC.

Allegedly, petitioners and other accused assaulted the

informant with Dagger, Lathi, Danta and other weapons. There is

specific allegation against petitioner no.1 that he gave several dagger

blows to the informant.

The impugned order of the learned Addl. Sessions Judge

reveals that the doctor has found two injuries on the person of the

injured and subsequently, injured was referred to PMCH on 10.6.2010

from where he was discharged on 18.6.2010. The nature of the injury

has not been mentioned in the impugned order dated 4.12.2010.

Admittedly, there is no specific allegation of any overt-act

against petitioner no.2. Accordingly, petitioner no.2, namely, Chandan

Kamkar is directed to be released on bail in connection with Dawath

P.S. Case no. 45 of 2010 on furnishing bail bond of Rs 10,000/- with

two sureties of the like amount each to the satisfaction of Sub

divisional Judicial Magistrate, Bikramganj, Rohtas.

So far as the petitioner no.1,namely, Paras Choudhary is

concerned, let carbon copy of the case diary of Dawath P.S. Case no.

45/2010 along with complete injury report of injured-Shyamji Singh,

if available, be called for from the court of Sub divisional Judicial

Magistrate, Bikramganj, Rohtas and list the matter after receipt of the

same.
