                                      JUDGMENT

Ramachandran Nair, J.

Since appeal filed against same assessee raising the same

questions for other years stands remanded vide our judgment in I.T.A

No.1554/2009, without issuing notice to the assessee, we allow the

appeal by setting aside the orders of the Tribunal and that of the first

appellate authority and remand the case to the Assessing Officer for

reconsidering the issues raised after giving opportunity to the assessee

based on judgment abovereferred. The Assessing Officer will serve a

copy of the judgment on the assessee along with notice proposing

revision of assessment.
