                                          ORDER

Shri Vinay Kumar, the appellant has filed this appeal dated 30.9.2010 before the
Commission against Kolkata Port Trust, Kolkata for not providing information to his RTI
request dated 22.7.2010, which came up for hearing on 06.07.2011 through
videoconferencing. The appellant was absent, whereas the respondents were represented
by Smt. S. Thakur, CPIO at NIC videoconferencing facility, Kolkata.

2. The appellant filed RTI-request dated 22.7.2009 seeking information on two RTI-
queries pertaining to license agreement and/or contract with KR Steel Union (O) Ltd with
regard to the land measuring about 4603.45 sq. mt. at ‘J’ Block, Sonai. The CPIO (Estate),
vide letter No. Lnd/RTI/Appl/9-10/03/09/1584 dated 26.8.2009 has denied information to
the appellant u/s 3 of the RTI Act.

3. Aggrieved by the reply of CPIO, the appellant preferred first-appeal dated
17.9.2009. The FAA vide order No. Admn/Misc.737/RTI Appeal/2009/082 dated
12.11.2009 has decided appellant’s first-appeal with the direction to CPIO to furnish the
information sought by the appellant within 15 days.

4. During the hearing the respondent submitted that she has not complied with the
orders of FAA, because the matter is sub-judice in Calcutta High Court. The Commission
observes that the CPIO should have complied with the directions of the FAA.

5. After hearing the respondent and perusing the relevant documents on file, the
CPIO is directed to provide reasoned reply to the appellant within two weeks of the
receipt of this order.

The matter is accordingly disposed of with the above direction.
