ORDER
1. The
applicant-original accused has filed this application for temporary
bail for a period of thirty days on the ground of sickness of his
wife.
2. Learned
advocate for the applicant has contended that wife of
applicant-accused is suffering from Adenomyosis i.e. thickening of
endometrium and operation is required which is fixed on 10/10/2011.
Learned advocate for the applicant has contended that for the said
purpose, presence of one responsible person is also required and no
other male person is there in the family of applicant-accused except
himself to look after his wife, therefore, the applicant-original
accused may be released on bail as prayed for.
3. Learned
APP Mr. Pandya has opposed this application.
4. Heard
both the sides and perused the papers including medical certificate,
produced on record before the Court in detail. In view of above
facts and circumstances, the application is partly allowed. The
accused-prisoner is ordered to be released on temporary bail for a
period of ten days i.e. from 09/10/2011 to 19/10/2011, on his
executing a personal bond of Rs.5,000/- (Rupees five thousand only)
and with one surety of the like amount to the satisfaction of the
jail authorities, on usual terms and conditions.
5. The
applicant-original accused shall surrender on 20/10/2011 before 5:30
p.m. before the concerned jail authorities. Rule is made absolute to
the aforesaid extent. Direct service is permitted.
