COMMON ORDER
1. This
Court on 23.06.2003 had passed the following order :-
ýSRULE. Ad-interim stay
of the execution of the award on condition that the applicant
deposits the entire amount payable under the award within four months
from today.ýý
2. Again on 01.05.2008,
this Court had passed the following order:-
ýSAs per the note
filed by the appellant / applicant dated 28.4.2008, it is submitted
by the learned Assistant Government Pleader that by mistake the name
of respondent No.1 was mentioned wrongly as Ajubhai Ratansang in the
memo of First Appeal as well as in the aforesaid Civil Application,
but the correct name is RAMJUBHA RATANSANG.
Looking to the facts
and circumstances of the case, corrected name is permitted to be
shown in the First Appeal as well as Civil Application.ýý
3. Heard the learned
counsel for the applicant. It is directed that the amount deposited
by the applicant, shall be invested in the FDR, initially for a
period of five years and thereafter shall be renewed from time to
time.
4. In view of the
above, the applications stand disposed of accordingly. Rule is made
absolute.
5. The Registry is
directed to list the appeals for hearing on 4th August,
2008.
