Heard Sri V.P. Srivastava, learned senior counsel along with Sri
Lav Srivastava, appearing for the applicant and learned AGA for
the State.
The submission made by learned counsel for the applicant is that
rice mill of the applicant was checked and 541.56 quintal rice was
found short as per stock register, due to which the licence of the
applicant was suspended and thereafter the matter about Mandi
Samiti tax was referred for compunding and fine of Rs. 20,000/-
was imposed as fine by S.D.M./Chairman, Mandi Samiti vide
order dated 12.11.2009, which has been paid by the applicant.
Next submission made by learned counsel is that no offence
against the applicant is made out and hence final report was
submitted but further investigation has been ordered.
It is also submitted that similarly placed co-accused Smt. Shail
Devi, (mother of the applicant) has been granted bail by another
Bench of this Court vide order dated 22.12.2009 passed in
Criminal Misc. Bail Application No. 34933 of 2009.
Having considered the submissions made by learned counsel for
the parties and keeping in view the facts and circumstances of the
case, applicant may be released on bail.
Let the applicant Nirmal Gupta son of Mohan Prasad Gupta, be
released on bail in case crime No. 1512 of 2009, under sections
419, 420, 465, 468 IPC, P.S. Kopaganj, District Mau on his
executing a personal bond of Rs. 25,000/- and furnishing two
sureties each in the like amount to the satisfaction of the Court
concerned.
