 ORAL ORDER

In view of the Judgment of this court reported in
1981 G.L.R. P.639 the court below has rightly rejected
the application vide impugned order. Consequently, this
court would not like to interfere with the impugned order
u/s 115 of the C.P.Code. Hence, this application is
rejected.
