Heard learned counsel for the applicant, learned A.G.A. and
perused the entire record of the case.
The submission of learned counsel for the applicant is that in all
the cases shown in the gang-chart, the accused-applicant is on
bail, as averred in paras 7 & 8 respectively of the bail
application. It is further submitted that this case under U.P.
Gangsters and Antisocial Activities (Prevention) Act has been
slapped on the accused-applicant by the police, in vengeance, so
that the accused-applicant may languish in jail for a considerable
long period. The applicant is in jail since 10.12.2009, as mentioned
in para 23 of the bail application, which has not been controverted
by the State.
Considering the overall aspects of the matter, I hereby provide
that the applicant be released on bail in Case Crime No.971 of
2009, under Section 2/3 U.P. Gangsters and Antisocial Activities
(Prevention) Act, 1986, P.S.Madiaon, District Lucknow, on his
filing a personal bond and two sureties each in the like amount to
the satisfaction of the court concerned.
