Rule.

Mr.Pujari, learned APP wavies service of notice of Rule for the
State and Mr.Buch, learned Counsel appears for respondents No.2 and
3 and waives service of notice of Rule.

The
present application is preferred by the applicants, who are claiming
to have interest in the muddamal,
for which the order has been passed by the trial Court.

Considering
the facts and circumsances, it appears that as the applicants are
claiming interest, with a view to enable this Court pass effective
order, if they are joined as party respondents in the proceedings of
appeal for representing their interest in the muddamal,
the same would meet with the ends of justice.

Hence,
the applicants are permitted to be impleaded as party respondents in
the proceedings of Criminal Appeal No.2247 of 2004.

The
application is allowed to the aforesaid extent. Rule made absolute
accordingly.
