Facts
arising from the complaint:
Mr. Shyam Lal Jain had filed a RTI application with Regional Manager, Shyam
Indus Power Solutions Pvt. Ltd. on 04/03/2010 asking for certain information. On not
having received any information within the mandated time the Complainant filed a
Complaint under Section 18 of the RTI Act with the Commission. On this basis, the
Commission issued a notice on 29/06/2010 to both the parties directing them to furnish
some information with respect to the establishment, control and finance of Shyam Indus
Power Solutions Pvt. Ltd. to the Commission before 25/07/2010.
The Respondent has informed the Commission vide letter dated 07/07/2010 that
Shyam Indus Power Solution Pvt. Limited is a Private Limited company incorporated
under the Companies Act, 1956 and is neither established by the parliament or state
legislature nor by any notification or order made by the appropriate government. It has
also been mentioned that this company is being controlled by its Board of Directors not
by the Government and is not financed directly/indirectly by any Government. Further,
the Commission has still not received any communication from the Complainant in
response to Commission’s notice dated 29/06/2010.
In view of the above stated facts, it is apparent that Shyam Indus Power
Solutions Pvt. Ltd. is not a public authority and as such is not covered under within the
meaning of Section 2(h) of the RTI Act, 2005.
Decision:
The Complaint is disposed off.
