3/ 03.03.2011 Heard learned counsel for the petitioners and learned
counsel for the State.
Petitioner, Smt. Kameshwari Kumari is purchaser from
the complainant and her sister, while petitioners of Cr. Misc. No.
42975 of 2010 are witnesses and identifier to the deed. Crime if
committed at their hand is recital as their having no concern with
land transferred by their brother. Defence is about recital decided in
between the parties.
Considering the facts and circumstances of the case,
prayer of the petitioners is allowed.
In the event of arrest or surrender within one month
from the date of receipt/production of a copy of this order in
connection with Complaint Case No. 1898 of 2009 above named
petitioners shall be released on bail on furnishing bail bond of Rs.
10,000/- (ten thousand) each with two sureties of the like amount
each to the satisfaction of J.M., Ist Class, Saharsa subject to the
conditions as laid down under Section 438(2) of Cr. P.C.
